1. INTRODUCTION

These Terms of Service (“Terms”) govern your access to and use of GoWap, a SaaS product operated by GoUp Digital Marketing Agency (“Company”, “we”, “us”, “our”).

By accessing or using GoWap, you agree to be bound by these Terms.

If you do not agree, you must not use the service.

2. DESCRIPTION OF SERVICE

GoWap is a software platform that:

  • Retrieves advertising performance metrics

  • Generates customizable KPI reports

  • Delivers reports via WhatsApp or email

GoWap is an independent software service and is not affiliated with Meta Platforms, Inc., Facebook, Instagram, or WhatsApp.

3. ELIGIBILITY

You must:

  • Be at least 18 years old

  • Use the service for lawful business purposes

  • Have authority to bind your organization to these Terms

4. ACCOUNT RESPONSIBILITIES

You are responsible for:

  • Maintaining confidentiality of your login credentials

  • All activity under your account

  • Ensuring the accuracy of information provided

  • Managing team access within your organization

You must notify us immediately of any unauthorized access.

5. META API & WHATSAPP API USAGE

GoWap uses:

  • Meta Marketing API (read-only advertising performance access)

  • WhatsApp Cloud API (transactional report delivery)

By connecting your Meta account, you authorize GoWap to access advertising performance data necessary to generate reports.

You agree to comply with:

  • Meta Platform Terms

  • Meta Marketing API Terms

  • WhatsApp Business Terms

Violation of these third-party terms may result in suspension of your account.

6. CLIENT CONSENT RESPONSIBILITY

If you add a client’s WhatsApp number or email address, you represent and warrant that:

  • You have obtained valid consent

  • The recipient has agreed to receive transactional reports

  • You are authorized to share that contact information

GoUp Digital Marketing Agency is not responsible for improper or unauthorized addition of contact data by users.

7. ACCEPTABLE USE

You agree not to:

  • Use GoWap for spam or promotional messaging

  • Send unsolicited marketing content via WhatsApp

  • Attempt to access unauthorized data

  • Reverse engineer the platform

  • Violate applicable laws or regulations

  • Abuse Meta or WhatsApp API rate limits

We reserve the right to suspend accounts that violate these terms.

8. DATA & PRIVACY

Your use of GoWap is also governed by our Privacy Policy.

We process data strictly for the purpose of generating and delivering advertising performance reports.

You retain ownership of your data. We do not sell or monetize user data.

9. SERVICE AVAILABILITY

We aim to maintain reliable service but do not guarantee uninterrupted availability.

We are not liable for disruptions caused by:

  • Meta API outages

  • WhatsApp service interruptions

  • Hosting provider downtime

  • Internet connectivity issues

  • Force majeure events

10. PAYMENT & PLANS

GoWap may offer multiple subscription plans.

By subscribing to a paid plan:

  • You agree to pay the applicable fees

  • Fees are non-refundable unless required by law

  • Failure to pay may result in suspension

Plan features may be limited based on subscription tier.

11. INTELLECTUAL PROPERTY

All platform content, design, branding, and software code are the intellectual property of GoUp Digital Marketing Agency.

You may not:

  • Copy

  • Modify

  • Distribute

  • Resell

  • Create derivative works

Without written permission.

12. TERMINATION

We may suspend or terminate your account if:

  • You violate these Terms

  • You misuse Meta or WhatsApp APIs

  • Required by law

  • You fail to pay subscription fees

You may terminate your account at any time by deleting your organization or contacting support.

Upon termination:

  • Meta tokens are revoked

  • Client contact data is deleted

  • Logs are removed according to retention policy

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

GoUp Digital Marketing Agency shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits

  • Loss of business opportunity

  • Data inaccuracies from Meta APIs

  • Message delivery delays

Our total liability shall not exceed the amount paid by you in the preceding 3 months.

14. INDEMNIFICATION

You agree to indemnify and hold harmless GoUp Digital Marketing Agency from any claims arising out of:

  • Unauthorized client contact usage

  • Violation of third-party API terms

  • Misuse of the service

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes shall be subject to the jurisdiction of courts in Tamil Nadu, India.

16. CHANGES TO TERMS

We may update these Terms periodically.

Continued use of the service after updates constitutes acceptance of revised Terms.
